The Meanest Man in Augusta? You Decide…

UPSHAWJames Upshaw could be the meanest man in Augusta. Here’s what deputies found when they answered a 911 call to his home on Gatewood Drive this month:

The deputy heard someone crying inside the door April 13 and knocked twice before Upshaw’s wife finally answered the door. Her eyes were red and it appeared she was crying. Inside the deputy found three teenagers standing in the hallway crying.

A 14-year-old boy told the officer he called 911 because he was tired of James Upshaw “hitting on his mother.” His 15-year-old sister then spoke up, agreeing that she was “tired of James Upshaw hitting her mother also.”

Cover Issue 748(For more crime news, pick up this week’s edition of The Jail Report, sold in local gas stations for $1.50.)

The officer asked the suspect’s wife what happened. He noticed a bag of ice on the table the victim standing in the dark. She would not turn on the light, so he shined his light on her face. Her left eye was swollen and turning blue.

The victim was scared to talk, according to the officer’s report.

“She advised me if she told on James Upshaw, he was going to come back and kill her. I asked her why she stated that and she stated he said that to her,” the officer said. “(She) refused to provide me any information on James Upshaw. She would not allow me to take a picture of her injury because she is afraid James Upshaw is going to kill her from the previous threats.”

The 15-year-old girl told the deputy that this wasn’t the first time James Upshaw had jumped on her mother. “She stated they were in the room when they heard a loud bang come from the bathroom and found James Upshaw on top of (their mom),” the officer said.

The girl’s 21-year-old brother tried to stop the assault, but James Upshaw pulled out a pocket knife and told him, “If you attempt to stop me, I will kill you.” That’s when the younger brother called 911.

“The kids in the residence are terrified of James Upshaw,” the officer said in this report. “They advised their mother in my presence that they were tired of him jumping on her and they wanted to move to get away from him. They are afraid James Upshaw is going to kill their mother if she does not get help or leave him.”

When the officer told the victim he planned to seek a warrant against her husband, she begged him not to. “Don’t do it because he will come back and kill me!” she said.

The officer said it was out of his hands because of her injury.

A warrant against the 35-year-old suspect was obtained for terroristic threats & acts as well as simple battery – family violence. Yet, authorities were unable to arrest Upshaw for 12 days. He was arrested Monday and remains in jail today under no bond.

The Aiken County Sheriff’s Office and South Carolina Law Enforcement Division (SLED) are currently investigating an early morning break in to the Perry Police Department and Town Hall.

On Thursday morning, around 1:52 am, a 911 caller notified the Sheriff’s Office Dispatch Center that it appears that two black males wearing dark clothing were breaking into 1075 E. Railroad Ave N. in Perry. When responding deputies and an officer from Wagener Police Department arrived on scene, they found forced entry on three buildings.

The witness informed deputies that the suspects fled the area in a vehicle prior to units arriving on scene. Investigators responded to the scene and were told by Chief Rushton of Perry P.D. that a dark blue 2009 Ford Crown Victoria, a handgun, shotgun and other police equipment was stolen during the burglary.

The preliminary investigation also revealed that the suspects damaged equipment and files inside one of the buildings. Around 10:30 am Thursday, investigators were able to locate the stolen vehicle in Orangeburg County on Root Road with some minor damage. It has been secured as evidence.

The other stolen property and weapons were not in the recovered vehicle and are still missing. Orangeburg County Sheriff’s Office is also assisting with the investigation as well. This investigation is still in its early stages and is currently on-going.

If anyone has any information about this investigation, we encourage them to contact the Aiken County Sheriff’s Office at (803) 648-6811 or they can contact Crimestoppers at 1-888-CRIME-SC.

GBI Investigating Woman’s Death at Richmond County Jail

Debra Leverett The GBI is investigating the death of female inmate at the Richmond County Jail, but authorities say it will NOT be a suicide.

Debra Leverett, 50, of Fairway Drive, Augusta, (pictured) had some medical issues that may explain her death on Sunday, authorities said. She has been held at the jail since her arrest March 30 for entering an automobile to commit theft. Because she was on probation for five years for a 2012 drug conviction, she was also put on hold for probation violation.

At 7:30 a.m. Sunday, deputies found Leverett unresponsive inside her cell at the Charles B. Webster Detention Center, according to Pat Morgan with the Georgia Bureau of Investigation. The coroner’s office pronounced her dead within the hour at the jail.

The sheriff’s office immediately asked the GBI to come in and conduct an independent investigation.

“Leverett’s body will be transported to the GBI Crime Lab in Decatur, where an autopsy will be performed,” Morgan said in a press release. “The investigation is ongoing.”

Her criminal record. Leverett was a customer at Palm Beach Tan on March 30 when she was accused of breaking into another customer’s vehicle while the victim and a tanning store employee had gone to a convenience store to get a drink. Everett allegedly took a suitcase, make-up and a cell phone from the victim’s vehicle, items that were recovered after a witness told deputies about seeing Leverett going through the car.

Leverett was serving five years of probation for a 2012 charge for illegal possession of prescription drugs. According to a report, deputies raided her home and found 140 Oxycodone pills, 700 Alprazolam pills and 50 Hydrocodone pills.

Because she was on probation during her March 30 arrest, she was being held at the jail longer for probation officials.

A former friend of the woman told The Jail Report that Leverett was known to clean houses but did not have a full-time job that he knew about.

An Appling man locked his wife in the closet by nailing it shut, keeping her in there all day after an argument over missing keys, authorities said.

Cover Issue 749(This is one of many stories in today’s Jail Report, available at gas stations in the area for $1.50.)

Christopher Marvin Shultz, 53, was charged last Wednesday with false imprisonment in the case. The victim’s daughter – Tamara Price (pictured below) – was also charged with false imprisonment for allegedly participating in the incident.

A man who works as a Lincoln County deputy was in Appling last Wednesday when he was flagged down by the victim. She told him that she had been locked in a closet all day. She said the door was nailed shut.

Christopher Marvin ShultzThe father and his daughter told authorities that the victim had stolen the keys to the family truck and locked herself in the closet, according to a sheriff’s report.

“We found out later that he had nailed her into the closet. When she went in the closet, he nailed it shut,” sheriff’s Capt. Butch Askew said.

Eventually, the husband let his wife out and even told her to watch out for the bent nails as she exited the closet. She left and flagged down the deputy.

Tamara Price“I’ve heard of false imprisonment before, but I’ve never heard it from them nailing the closet door shut,” Capt. Askew said. “Apparently, after an argument over missing keys, the daughter and husband decided to lock her in the closet.”

Investigators went into the home at 3030 Ray Owens Road and found bent nails sticking out of the closet door.

A sheriff’s report says Shultz is owner of Shultz Construction and his daughter works as a housekeeper for a local hotel.

RCSO Deputies Taser Man in Face; Suspect Claims Police Brutality (Video)

Devaje Mathis Facebook photoRichmond County deputies say they accidentally shot a local man twice in the face with a Taser outside a Broad Street bar last weekend, an incident the suspect is calling “police brutality.”

Devaje Mathis, 23, of Aiken, posted a bloody image on his Facebook page of two Taser prongs sticking out of his face. He wrote this:

“I don’t have no respect for how the cops treated me. It Was Police brutality. They shot me more then once with the taser and then pulled some out so nobody would know. They pushed there knee on the side of me and pulled out some. They treated me bad. They even disrespected me in the hospital. It was a mess. I have no trust for these people. They wanted to take me out but God didn’t let them. I was aware the whole time. I even could feel how much he pressed on the taser. Fuc@$ the police.”

Devaje from videoWitness Carrie Mitchell recorded two videos (click here and click here) after the Taser incident, showing Mathis lying on the ground near a patrol car as officers wait for an ambulance to arrive.

RCSO Chief Deputy Pat Clayton said the arresting deputy did not shoot Mathis in the face on purpose, saying it is against their policy to aim for the face.

“Deputy Ty Dailey was attempting to make an arrest on two suspects that were fighting (April 30) at the Playground Bar,” Chief Clayton said in a statement to The Jail Report. “The suspect in question (shown on Facebook) was attempting to resist arrest.  During the struggle, Deputy Dailey had to shoot his Taser on two different occasions because the two prongs did not make a full contact. During the course of the struggle, the suspect was accidentally shot in the face.”

DAVAJE MATHISChief Clayton said it is not policy to shoot suspects in the face with a Taser since it is a dangerous area due to the eyes and soft tissue.  But it does happen sometimes “due to the quickly evolving and highly volatile situation we find ourselves,” he said.

RCSO policy is to remove Taser prongs only from the torso, legs and buttocks. Officers are not allowed to remove them from the face, head, neck, bones and scrotum. That is done at a medical facility, Chief Clayton said.

In this case, Mathis was taken to the emergency room at University Hospital to have the prongs removed. He remained there for several hours before he was transferred to the Richmond County Jail to be booked for obstruction of an officer. He has since been released on bond.

Deputy Ty DaileyWhat the police report says.  According to a sheriff’s report, Deputy Dailey (pictured) escorted two suspects out of The Playground bar at 1:48 a.m. April 30 for what appeared to be possession of marijuana. That’s when Mathis approached the deputy and said he was the brother of one of the men.

“He was asked multiple times to step back, but he refused,” Deputy Dailey said in his report.

An investigator asked Mathis to leave, and when Mathis refused to leave, Deputy Dailey told him he was under arrest for disorderly conduct. He took Mathis by the arm to take him into custody.

“(Mathis) snatched his arm away and shoved off of me once. I grabbed him a second time and was pulled forward,” the officer’s report says. “Inv. Perkins deployed his Taser and the subject fell to the ground. After a short period of time, he began pushing off of the ground to stand and kicking out as I approached him.”

Deputy Dailey said he deployed his Taser once, but both cartridges fired. Mathis had multiple prongs in his left side and two struck him in the left side of his chin, the report says.

For his part, Mathis claims deputies laughed at him at the hospital while he was in pain. He warned his Facebook friends to be careful and praised God for saving him. He told friends to “stay prayed up.”

Benjamin BoehnleinA Martinez man wanted his computer repaired at a local store but ended up losing it – and his freedom – after an employee found more than 400 images of child pornography on it, authorities said.

Benjamin Boehnlein, 31, was arrested Friday and charged with one count of computer pornography. More charges are possible as the FBI becomes involved.

According to a sheriff’s report, the suspect took his custom-built AMD computer tower to Computer Exchange last Monday to have Windows 10 downgraded to Windows 7. During the process, the employee found “several suspicious pictures and videos” and alerted the sheriff’s office. Authorities say the images included “several nude pictures of juvenile females,” leading to his arrest.

computer towerSpecifically, a warrant says the suspect had possession of over 400 images of “nude pre-pubescent to pre-teen girls engaged in sexually explicit conduct.”

The computer was seized while authorities obtain a search warrant, and a FBI task force that looks into sex crimes has joined the investigation.  The task force will investigate whether this is an isolated incident and not part of sex trafficking. Authorities say they want to make sure there was no effort to solicit any underage girls.

Authorities say the computer store on Washington Road was trying to “do the right thing,” but stores are not required by law to alert police if they find illegal pornography.

Meanwhile, Boehnlein remains in the Columbia County Detention Center under no bond.

Cover Issue 750(For more crime news, pick up this week’s Jail Report, sold in local gas stations for $1.50.)

Brown’s arrest was made over month after the incident occurred. At 8:43 p.m. on March 29, a deputy was called to Jones Street for a child left inside a vehicle unattended. Duty Kenneth Mercer found the 10-year-old child locked inside a 2001 Gold Toyota Avalon (like the one pictured below).

The boy is autistic and appeared to have been left for “an unknown period of time,” a sheriff’s report says. Brown – a “caregiver” with Lizzy Adult Daycare – later returned and said the boy was a client in his custod. He claimed that he left the boy with another man while he went inside the Family Y to meet some friends, a report says.

The child’s mother was notified and came to the Jones Street to get her son. The Department of Family and Children Services was notified and Melvin Parker with Lizzy Adult Daycare was also notified.

The Jail Report tried calling Lizzy Adult Daycare several times for comment, but a fax machine answered and we were unable to leave a message.

An Augusta man violently attacked his younger roommate Monday, putting a belt around his neck and choking him with it before finishing the assault with a hammer to the head and knife to the body.

ChamblissThe victim, 25-year-old Zachary Chambliss (pictured at right), was rushed to Augusta University Medical Center and admitted to the Shock Trauma Center for multiple injuries.

The suspect, 41-year-old James Austin Rebillard, did not immediately surrender Monday after the assault. After a few minutes of deputies banging on the door, Rebillard surrendered to deputies in bizarre fashion: by crawling out on his knees. A deputy then heard the suspect talking to himself on the way to jail, a report says.

The attack happened around 8 p.m. Monday at the pair’s home at 404 Shallowford Circle in Augusta. Deputies were called to a stabbing and found the victim laying in the grass by the road. He was alert enough to tell deputies what happened:

“He was playing a video game in the living room, when the suspect entered the room behind him and put a belt around his neck, choking him,” a report says. “Mr. Chambliss stated they then started fighting and Mr. Rebillard struck him in the head with a hammer. The victim stated when he tried to take the hammer, Mr.Rebillard stabbed him with a knife in the left arm, right side, and the buttocks.”

RebillardThe suspect had a different story. He claimed that he was in his garage when the younger roommate came in there and started choking him. But he didn’t say how.

“It all went black, but I think I got him,” Rebillard reportedly said to deputies.

Rebillard was charged with aggravated assault and weapon possession. He remained Wednesday in the Richmond County Detention Center.

A deputy court clerk in Richmond County was charged Tuesday with stealing over $1,000 in fines paid to the Magistrate Court Clerk’s Office.

FIGUEROAEstela Figueroa, 46, of Andorra Drive, Hephzibah, was arrested on a felony charge of theft by taking. She has since been released on bond.

Figueora has worked as deputy court clerk since 2010, but she was fired Friday after confessing to taking the money, according to Vickie Hester, Clerk of Civil and Magistrate Court.

Specifically, the clerk is accused of stealing the fines paid by four people who were cited for disorderly conduct. The four people had paid the fines at the courthouse at 735 James Brown Boulevard. This occurred four different times from December 2015 to April 2016.  A total of $1,140 was taken, according to a sheriff’s report.

Those who paid the fines had their payments credited without any problem, Hester said.

“They are listed as being paid, and the folders even state that they paid,” Hester told The Jail Report. “She would create a receipt, then she would void the receipt and take the money. But the paperwork shows that they are paid.”

Hester said she discovered the theft April 28 when Sentinel Offender Monitoring Services called to ask whether a specific person had paid their fine. The folder showed they had paid the fine but there was also a void receipt.

Asked about the discrepancy, Figueora she said she couldn’t remember. Then others were found and she confessed when confronted, Hester said. She was charged with a felony since the theft involved government property.

According to county records, Figueora was hired in February 2010 and was promoted several times, finally earning the title of Deputy Court Clerk IV with an annual salary of $30,668.

The Dumbest Question Ever for Sheriff Roundtree?

From last week’s Q&A column by Sheriff Richard Roundtree in The Jail Report:

Question: Why do your officers beat inmates like slaves, then lock them in the hole until they heal? They do a lot of dirty things to people behind them walls that people have no idea about.   – Antonio Tyrone Knight

Sheriff Roundtree: Mr. Knight, you sir, are an idiot. The only reason that I reply to questions like yours – and trust me you are not the only idiot to have submitted a question, so do not feel bad – is because I want everyone who knows you to realize just how ridiculous you sound. I mean, here you have the opportunity to directly interact with the sheriff of the county, and your question is why do we beat inmates like “slaves” and throw them into a hole.

Since I have been in office we have not had one lawsuit or one attorney complain that their client was beaten and thrown in a hole, not even from you. My suggestion to you and all those you feel you represent is that if you stay at a place that you feel treats you poorly, here is the punchline: DON’T GO BACK!  You’re welcome.

Richmond County Sheriff Richard Roundtree happily answers your questions each week in the print edition of The Jail Report. Submit your question on our Facebook page under this post, or you can email them to publisher@thejailreport.com or text it to 803-487-3224.

The teen allegedly provided Terry with the firearm and ammunition and went with him to shoot the 25-year-old victim at Jennings Homes Apartments in Augusta.

McKieMcKie (pictured) was transported and admitted to Augusta University hospital for injuries to the upper right arm, right thigh, left middle finger and is currently in stable condition, the warrant says.

There is no word from authorities on whether Terry was shot in a gunfight with the female neighbor or a motive in the shootings.

Parks has been charged with aggravated assault and possession of a weapon, a .38-caliber revolver. He remains in the Richmond County Jail under no bond.
